Capital Settlement

This settlement covers Capital BlueCross, Capital Advantage Insurance Company and Keystone Health Plan Central, Inc..

On February 1, 2008, Capital BlueCross, Capital Advantage Insurance Company and Keystone Health Plan Central (collectively, “Blue Plan”), entered into a Settlement Agreement with physicians. The settling parties filed their Joint Motion for Preliminary Approval of Settlement on February 1, 2008 and the court issued its preliminary approval order on March 12, 2008. Settlement Notice Packets were mailed to Class Members on April 1, 2008. The Court has scheduled a hearing to consider the fairness, reasonableness, and adequacy of the proposed Capital BlueCross Settlement (“Settlement Hearing”). The Settlement Hearing will be held on Friday, June 13, 2008, at 2:00 pm at the United States Courthouse, Courtroom IV, Tenth Floor, Federal Justice Building, 99 Northeast Fourth Street, Miami, FL 33132.

Dates to Remember:

• The opt-out deadline is May 30, 2008
• The objection deadline is May 25, 2008
• The claims submission deadline is June 30, 2008 (see claim form information below)
