- Second Blue Cross Claim Form Mailed Regarding Highmark Settlement
Starting early December, physician practices received Notices, Claim Forms and Claim Instructions for a second settlement in the Love case with Highmark Blue Cross Blue Shield. This $10 million settlement in addition to and separate from the earlier Blue Cross settlement, and covers four additional Blue Cross plans including Highmark Inc., Keystone Health Plan West, Inc., Highmark West Virginia, Inc. (d/b/a Mountain State Blue Cross Blue Shield) and Parker Benefits, Inc. (d/b/a Super Blue HMO). These completed proof of claim forms must be postmarked no later than February 27, 2008. To opt out of the settlement, the settlement administrator must receive the opt-out form by January 14, 2008. Please note that you are eligible to participate in both settlements. All physicians who provided services to any Blue Cross plan can participate in this settlement. If physicians have done business with any of the Highmark plans, they could qualify for an increased share of the settlement. In order to qualify for up to 5 or 10 times the base amount, the practice must calculate its gross receipts from the five plans listed above. - Highmark Update: Please be advised that a motion has been granted to move the Fairness Hearing date from January 31, 2008, to February 11, 2008 at 9:30am. THIS DOES NOT AFFECT ANY OF THE OTHER DATES IN THE NOTICE (i.e., claim filing deadline, opt out deadline and objection deadline).
- Highmark Settlement Note: Due to a typographical error, the AAPP Foundation and the American Psychoanalytic Foundation were inadvertently excluded from the list of charitable organizations list on page 4 of the Claim Form Instructions. If you would like to donate your proceeds from the settlement fund to either of these foundations, please indicate the number for the foundation of your choice on your claim form and the settlement administrator will honor your request.

- United Healthcare Dismissal Upheld:
The U.S. Court of Appeals for the 11th Circuit in Atlanta has upheld the previous summary judgment ruling dismissing the federal RICO lawsuits against UnitedHealth Group. The previous dismissal was based primarily on technical grounds. Societies with actions in state court and arbitrations will now consider whether to proceed pursuing those actions.
